These Terms of Service ("Terms") govern the use of the FluxDrive service ("Service") operated by Insolitum Sp. z o.o., a company registered in Poland with its registered office at ul. Chwarznieńska 198F, 81-602 Gdynia, entered in the National Court Register (KRS) under number 0001166174, NIP: 9581753176, REGON: 541402165 ("Operator", "we", "us").

By accessing or using FluxDrive, you ("User", "you") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Service Description

FluxDrive is a media transfer service that enables users to:

The Service is designed to maintain original file quality during transfers without compression. Share codes expire automatically after 24 hours from creation.

• •Generate unique 6-digit access codes for file sharing
• •Share files with recipients who do not need to create an account
• •Organize files in folders and share entire folders via codes

3. Account Registration

To upload files and create share codes, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Recipients of share codes do not need to create an account to download files.

5. Acceptable Use Policy

You agree to use FluxDrive only for lawful purposes. The following content is strictly prohibited:

We reserve the right to remove any content and terminate accounts that violate these Terms without prior notice.

• •Illegal content, including but not limited to child sexual abuse material (CSAM)
• •Copyrighted content without authorization from the rights holder
• •Malware, viruses, or any malicious software
• •Content that violates the rights of third parties
• •Content promoting violence, terrorism, or hate speech
• •Spam or unsolicited commercial content

6. Anti-Abuse Measures

To protect the Service and its users, FluxDrive implements the following security measures:

• •Rate limiting: Maximum 20 code redemption attempts per 10 minutes per IP address
• •Code protection: Maximum 5 redemption attempts per 10 minutes per code
• •Brute-force protection: After 10 failed attempts, a 30-minute cooldown is enforced
• •Device fingerprinting: Each code can only be used by a limited number of unique devices
• •MIME type validation: Only allowed file types can be uploaded

7. Intellectual Property

You retain all ownership rights to the content you upload to FluxDrive. By uploading content, you grant us a limited license to store and transmit your files solely for the purpose of providing the Service.

The FluxDrive name, logo, and Service design are the property of Insolitum Sp. z o.o. and may not be used without our prior written consent.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any data loss resulting from technical failures or user error.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Insolitum Sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the Service.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us at hello@insolitum.ai. We may terminate or suspend your account immediately, without prior notice, for violation of these Terms or for any other reason at our sole discretion.

11. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes arising from these Terms or the Service shall be resolved by the courts competent for the registered office of Insolitum Sp. z o.o. in Gdynia, Poland.

For consumers residing in the European Union, mandatory consumer protection laws of your country of residence may apply.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
